If the person is not satisfied by the internal review, or does not want one, they can ask the Information Commissioner to review the decision.
They have 40 working days from being told of the decision to apply to the Information Commissioner for a review. There is no fee for this review.

The Information Commissioner cannot review a decision that has already been reviewed by the Administrative Decisions Tribunal.
review recommendations
On reviewing a decision the Information Commissioner can make recommendations about the decision to the agency including that the agency reconsider its decision.
The Information Commissioner can also make a recommendation to an agency about its general procedures in dealing with access applications to improve its compliance with the GIPA Act. The Information Commisisoner cannot make binding decisions.

As at 30 April 2012 the OIC had 160 open matters, made up of 9 open complaints, 148 open reviews and 3 open investigations.
The OIC had finalised in total 507 matters, made up of 117 closed complaints, 386 closed reviews and 4 closed investigations.
We have received, in total, 667 cases fom 1 July 2010 to 30 April 2012.
